Welcome to Essence Awakening. These Terms & Conditions ("Terms") govern your use of the website essenceawakening.com and the Essence Awakening mobile app (together, the "Services"). By using the Services, you agree to these Terms.
1. WHAT WE PROVIDE
The Services offer mindfulness and wellness content — guided practices, breathing exercises, and self check-ins — and let you book and manage sessions with a therapist.
2. NOT MEDICAL ADVICE; NOT FOR EMERGENCIES
The app's practices, tips, and content are for general wellness purposes only. They are not medical or mental-health advice, diagnosis, or treatment, and they are not a substitute for care from a qualified professional. Never disregard professional advice because of something in the Services.
The Services are not an emergency service. If you are in crisis, call or text 988 (Suicide & Crisis Lifeline, US), text HOME to 741741, or contact your local emergency services immediately.
3. THERAPY SESSIONS
Sessions booked through the Services are provided under a separate clinical relationship between you and your therapist, including the consent forms and policies your therapist provides. These Terms govern the booking technology, not the therapy itself.
4. YOUR ACCOUNT
You may browse and use the app's practices as a guest. To book or manage sessions you must create an account with accurate information. You are responsible for keeping your login credentials confidential and for activity under your account. You must be at least 18 to book a session, or have the involvement of a parent or guardian as required by law.
5. BOOKINGS, PAYMENTS, AND CANCELLATIONS
Payments for sessions are processed securely by our platform provider, Wix, at the prices shown at booking. To cancel or reschedule, please do so at least [24 hours] before your appointment. Late cancellations or missed appointments may be charged in accordance with the policy provided at booking or by your therapist.
6. ACCEPTABLE USE
You agree not to misuse the Services — including attempting to interfere with their operation, accessing them by automated means, infringing others' rights, or using them for any unlawful purpose.
7. OUR CONTENT
The Services and their content — including text, design, logos, audio recordings, and guided practices — belong to Essence Awakening or our licensors and are protected by intellectual-property laws. We grant you a personal, non-transferable license to use the Services for your own non-commercial use. You may not copy, distribute, or create derivative works from our content without permission.
8. THIRD-PARTY SERVICES
The Services rely on third parties (such as Wix for accounts, bookings, and payments, and Apple for app distribution). Their terms and privacy policies apply to their services.
9. DISCLAIMER AND LIMITATION OF LIABILITY
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, and we are not liable for indirect, incidental, or consequential damages arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
10. TERMINATION
You may stop using the Services or delete your account at any time. We may suspend or terminate access that violates these Terms or harms the Services or other users.
11. CHANGES
We may update these Terms from time to time. If we make material changes, we will update this page and the effective date above. Continuing to use the Services after changes take effect means you accept the updated Terms.
12. GOVERNING LAW
These Terms are governed by the laws of the State of [State], without regard to conflict-of-law principles.
